Gary Busey was spotted exposing himself in public this past Thursday in Malibu. The paparazzi photo of the 79-year-old Lethal Weapon actor urinating on a bush started circulating shortly after the incident took place. Though this kind of erratic behavior seems to be par for the course for Busey, it doesn’t seem like he was trying to get a rise out of anybody but rather got caught in the act trying to relieve himself.

It goes without question that urinating in public, especially in broad daylight, isn’t model behavior by any stretch of the imagination. But we’d be hard-pressed to say that many of us haven’t considered doing the same thing under extenuating circumstances. In other words, even celebrities like Gary Busey have to answer nature’s call if the situation is dire enough.

It’s worth noting, however, that Gary Busey appears to be smiling from ear to ear as if he’s egging on the photographer after being spotted with his pants down. Whether he was marking his territory or just shocked by being caught on camera is up for debate, but he certainly seems to be enjoying himself.

TMZ reached out to Gary Busey’s representatives, but as of this writing, they haven’t made a comment about the incident. It also remains to be seen if he will get in trouble for dropping his sweatpants to do his business, as public urination falls into a sort of legal gray area, depending on the situation.

It’s not unheard of for instances of public urination to be charged as indecent exposure under Penal Code 314. But in order for such a charge to actually be filed under Penal Code 314, it would require additional forms of lewd conduct because it’s more often than not reserved for offenses of a sexual nature. So even though Gary Busey did, in fact, expose himself in public, he wasn’t posing an imminent threat to anybody as far as we know.

In extreme cases, public urination carries a maximum punishment of 6 months in jail and/or a $500 fine. What’s more, if an individual is charged with indecent exposure under Penal Code 314, they could potentially be required to register as a sex offender for life under Penal Code 290. Since Gary Busy was simply going to the bathroom in a less-than-ideal setting, it’s not unreasonable to assume that the only real consequence he’ll experience will come in the form of the embarrassing photos that are already circulating the internet.

Gary Busey’s current mental state is being called into question because this isn’t the only form of erratic behavior he has recently engaged in. Just this past September, Busey was accused of fleeing the scene after allegedly rear-ending a woman’s car, but he didn’t face any charges for the incident. Though footage of a woman confronting Busey made its rounds on the internet, it’s worth noting that the incident itself wasn’t captured on tape.

But still, if Gary Busey actually rear-ended another motorist, his reaction to the entire situation is one that should cause just the slightest bit of alarm. In Busey’s case, he nonchalantly told the motorist he wouldn’t be giving her any information and drove off while listening to “Wouldn’t It Be Nice” by The Beach Boys.

No charges have been filed against Gary Busy at the time of this writing.
