Former Disney actor and Hannah Montana star Mitchel Musso was recently arrested in Rockwall, Texas, on charges of theft and public intoxication. The actor has now spoken up about the arrest to Entertainment Weekly, saying that the incident was a misunderstanding and stating, “I was absolutely not drunk or drinking, and there was 100% no theft.”

Meanwhile, a press release from the Rockwall County Police Department provides more details about the charges.

According to the press release, the Disney star was arrested on Saturday evening on charges of public intoxication and theft of an item under $100, specifically, a bag of chips. Officers who responded to a call were told that an individual appeared intoxicated and that he had walked into the hotel, grabbed a bag of chips, and began eating them.

Musso, however, denies that he ever opened the bag of chips and that the hotel employee was “disgruntled” and refused to serve him since he was only wearing a pair of board shorts.

The former Disney actor further spoke on the arrest charges, saying that he and some friends were getting snacks from the hotel after docking their boat nearby. Musso claimed that the employee was “agitated from the get go,” while the press release states that Musso became verbally abusive to the hotel staffer when asked to pay for the chips. However, Musso says, “I was the one who was being verbally abused and also harassed.”

While Musso said that the responding officers initially told him that the hotel wouldn’t be pressing charges, he said that multiple cop cars and officers suddenly arrived on the scene, adding, “that’s when I got scared.”

It’s clear that the former Disney star feels that he was wronged and that the arrest shouldn’t have happened, while the hotel feels the opposite. EW reached out to the hotel for comment, and the manager declined, saying the incident was sensitive, though he did reply, “You know what, he can say whatever he wants to say,” when told that Musso claimed the employee verbally harassed him.

The press release is pretty straightforward about the Disney star’s arrest, as it claims that the officers determined that Musso was intoxicated and decided to take him into custody.

“The truth’s gonna come out. I’ve never stolen anything in my life and did not steal any chips nor was I drunk or drunken or drank or inappropriate to anybody inside that hotel.”

Additionally, a records check revealed that Musso had several outstanding traffic warrants and received additional charges of expired registration, failure to display a driver’s license, and violating a promise to appear. Musso claims the unpaid tickets are the reason he was ultimately arrested.

While EW has reached out to get the Disney star’s full arrest report, a copy of it has not yet been sent to the outlet. Musso was released from jail on a $1,000 bond after spending the night, and he further shared with EW that he returned to the studio afterward to work on his upcoming album and that he also has a film coming up that he can’t share details of yet.

With these two conflicting reports between the actor and the hotel, it seems unlikely that we’ll be finding out exactly what went down at the hotel anytime soon, but Musso ended his interview optimistically by saying, “The truth’s gonna come out,” adding, “I’ve never stolen anything in my life and did not steal any chips nor was I drunk or drunken or drank or inappropriate to anybody inside that hotel.”
